1. About RS3 DESIGNZ

RS3 DESIGNZ is an independent digital studio based in Atlanta, Georgia. We provide focused website services, practical lead-follow-up automation, creative support, free browser-based frontend tools, and digital resources.

2. Eligibility and Acceptance

You may use the website only if you can legally enter into an agreement. If you use the website or purchase services for a business or organization, you represent that you have authority to act for that organization. If you do not agree to these Terms, do not use the website or purchase its products or services.

3. Project Proposals and Website Services

Website builds, custom design work, creative support, consulting, and other client services may be governed by a separate written proposal, statement of work, invoice, order form, or service agreement. That document may specify the project scope, deliverables, revisions, schedule, client responsibilities, payment terms, ownership, hosting, maintenance, and cancellation terms.

If a project document conflicts with these Terms, the project document controls for that project. Estimates and projected completion dates are provided in good faith but may change if the scope changes, information or approvals are delayed, or circumstances outside our reasonable control arise.

4. Lead Rescue Services

Lead Rescue is a lead-follow-up workflow designed to help receive website inquiries, send prompt confirmations, notify a business, and organize inquiry information. Features and integrations may vary according to the selected setup, proposal, or plan.

Lead Rescue supports a business’s follow-up process but does not replace human review, customer service, professional judgment, or the business’s responsibility to respond. We do not guarantee that every inquiry will be delivered, that third-party email or automation systems will operate without interruption, or that use of Lead Rescue will produce a particular number of leads, customers, sales, or revenue.

5. Client Responsibilities

Clients using our services are responsible for:

• Providing accurate information, content, account access, approvals, and feedback reasonably needed to complete the work.
• Confirming that they have permission to use any text, images, logos, customer data, software, or other materials supplied to us.
• Reviewing and testing deliverables before public launch or production use.
• Maintaining lawful privacy notices, consent language, marketing practices, and communications with their own customers and leads.
• Protecting account credentials and promptly reporting suspected unauthorized access.
• Maintaining appropriate backups unless a written agreement specifically assigns that responsibility to RS3 DESIGNZ.

6. Free Frontend Tools

Our free calculators, converters, CSS generators, and related frontend utilities may be used for personal, educational, or commercial projects. Values and code outputs generated by these tools may generally be copied, modified, and incorporated into your projects without attribution.

You are responsible for reviewing and testing all generated output before using it in a live project. You may not scrape the tools at scale, overload or probe the website, bypass access or security measures, copy the tools themselves for redistribution, or use automated requests in a manner that disrupts the service.

7. Digital Products and Licenses

Unless a product page or included license states otherwise, purchasing a digital product grants you a limited, non-exclusive, non-transferable license to use that product for the uses described at the time of purchase. RS3 DESIGNZ retains ownership of the original product and associated intellectual property.

You may not resell, redistribute, sublicense, share, upload, or make the original source files available to others as standalone files, competing products, stock assets, templates, download collections, or shared-library resources. Product-specific license terms supplied with a download or displayed at checkout are part of these Terms and control if they conflict with this general section.

8. Orders, Payment, and Refunds

Prices, payment schedules, accepted methods, taxes, and delivery terms will be displayed at checkout or included in the applicable proposal or invoice. You agree to provide accurate billing information and authorize the applicable payment provider to process the stated charges.

Because digital products can normally be accessed or downloaded immediately, they may be non-refundable after access or download unless a different refund policy is displayed at purchase, the file is materially defective, or applicable law requires otherwise. If a download is defective or inaccessible, contact us so we can attempt to replace or correct it.

Refunds, deposits, cancellations, late payments, and ownership for custom services are governed by the applicable proposal, invoice, or service agreement.

9. Intellectual Property

The RS3 DESIGNZ name, website design, branding, original graphics, written content, tutorials, product files, software, and other original materials are owned by RS3 DESIGNZ or used with permission and are protected by applicable intellectual-property laws. Except for the limited permissions expressly provided in these Terms or a product license, no rights are transferred to you.

Ownership of custom client deliverables will be stated in the applicable project agreement. Third-party components, fonts, plugins, stock assets, and open-source materials remain subject to their respective licenses.

10. Acceptable Use

You agree not to use the website, products, tools, or services to:

• Violate any law, regulation, contract, privacy right, or intellectual-property right.
• Transmit malware, harmful code, spam, fraudulent inquiries, or abusive material.
• Attempt unauthorized access to accounts, systems, data, or restricted areas.
• Interfere with the website’s availability, security, or normal operation.
• Misrepresent your identity, affiliation, authority, or the source of content.
• Use Lead Rescue or related systems to send unlawful or non-consensual marketing communications.

11. Third-Party Services and Links

The website and our services may depend on or link to third-party platforms, including hosting, WordPress plugins, WooCommerce, form providers, automation platforms, Google services, email providers, payment processors, analytics, advertising networks, and other integrations. Those services are governed by their own terms and privacy policies.

RS3 DESIGNZ does not control third-party services and is not responsible for their content, policies, outages, changes, data practices, or continued availability. A change made by a third party may require an adjustment, replacement service, additional work, or a change in functionality.

12. Advertising and Affiliate Links

Some free tools, educational pages, or other website content may contain advertising or affiliate links. RS3 DESIGNZ may receive compensation when a visitor views an advertisement, clicks a link, or completes a qualifying purchase. Unless expressly stated, the presence of a link or advertisement does not constitute a guarantee or endorsement of a third-party product or service.

13. No Guaranteed Results

Examples, demonstrations, projections, conversion discussions, testimonials, and case studies are provided for informational purposes and do not guarantee future performance. Results depend on many factors outside our control, including the client’s offer, traffic, pricing, market, customer service, follow-up, technical environment, and third-party platforms.

14. Disclaimers

To the fullest extent permitted by applicable law, the website, free tools, digital products, informational content, and any service not covered by a separate written warranty are provided “as is” and “as available.” RS3 DESIGNZ disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and compatibility.

We do not warrant that the website, tools, automation, downloads, or third-party integrations will always be uninterrupted, secure, current, error-free, or compatible with every device, browser, framework, or service. You are responsible for testing code, files, websites, and workflows before relying on them in production.

15. Limitation of Liability

To the fullest extent permitted by law, RS3 DESIGNZ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, goodwill, or business interruption arising from use of—or inability to use—the website, products, tools, services, or third-party integrations.

Where liability cannot legally be excluded, RS3 DESIGNZ’s total liability for a claim will not exceed the amount you paid RS3 DESIGNZ for the product or service directly giving rise to that claim during the six months before the event, or fifty U.S. dollars if no payment was made. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

16. Responsibility for Misuse

You are responsible for losses or claims caused by your unlawful use of the website, products, tools, or services; your violation of these Terms; or materials you supply without the necessary rights or permissions. This responsibility applies only to the extent permitted by applicable law.

17. Suspension or Termination

We may restrict or suspend access to the website, tools, downloads, or services when reasonably necessary to address nonpayment, misuse, unlawful activity, security risk, disruption, or a material violation of these Terms. Project termination, refunds, file delivery, and transition assistance for paid client work will be handled according to the applicable project agreement and applicable law.

18. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any dispute that is not governed by a separate written agreement will be handled in a court with appropriate jurisdiction in Georgia, unless applicable consumer law requires otherwise.

19. Changes to These Terms

We may update these Terms as the website, products, services, or legal requirements change. The revised Terms will be posted on this page with a new “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.

20. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms, the Privacy Policy, applicable product licenses, and any project-specific proposal or agreement form the complete agreement concerning the applicable website use, product, or service.
